Governor Signs Risk Transfer Bill

Pro rata liability measure passes after two years of vetoe

Colorado Gov. Bill Ritter signed SB07-087 into law last Wednesday, which prohibits the practice of shifting financial responsibility for one’s own negligence to another party in construction agreements.

This legislative session marks the fourth year that the American Subcontractors Association and its partners in the Colorado Construction Reform Coalition have argued in support of pro rata liability as the fair and equitable way of doing business.

Before signing the bill, Ritter said that “after hearing from all sides,” he believed the legislation was “one that would be good for Colorado business.”

The bill’s sponsors said the legislation would be good for all construction businesses.

“SB 87 is about fairness and equity in the business environment and that it is good for business and good for consumers and, therefore, good for Colorado,” said Rep. Randy Fischer, who co-sponsored the bill with Sen. Abel Tapia.

SB07-087’s passage in 2007 marks the third consecutive year that the Colorado Legislature has passed a pro rata liability bill with bipartisan support. The measure was vetoed by then-Gov. Bill Owens in 2005 and 2006.

ASAC President Robert Wilson said that, for the first time in a long time, public policy in Colorado has taken a step forward in addressing the reform needed in the construction business environment. 

“SB 87 will have a positive and profound impact on Colorado construction,” said Wilson of Zimkor LLC.

Members of the Colorado Construction Reform Coalition include the American Council of Engineering Companies of Colorado, Architectural Woodworking Institute, Associated Wall and Ceiling Industries, Colorado Glazing Contractors Association, Colorado Roofing Association, Independent Electrical Contractors-Southern Chapter, Mechanical Contractors Association, National Electrical Contractors Association, Painting and Decorating Contractors Association of Colorado, Plumbing and Heating Contractors of Colorado, Sheet Metal Contractors Coalition, Sheet Metal and Air Conditioning National Association, Professional Independent Insurance Agents of Colorado, Rocky Mountain Masonry Institute, Residential Air Conditioning Association and the Rocky Mountain Steel Construction Association.

Fransen Pittman Breaks Ground on New Church

Fransen Pittman General Contractors has broken ground on the new Immaculate Conception Roman Catholic Church in Lafayette, scheduled for completion in January.

Eidos Architects designed the 28,485-sq-ft building, which sits on an 11-acre site in the Cabrini Gardens subdivision. Extensive site work will be required for the $5.5-million project, which will feature a steel-framed facility with a masonry veneer and stucco accents, an exposed pitched roof with concrete tiles and clerestory over the sanctuary.

The 500-seat sanctuary will feature Glu-Lam beams and exposed wood decking. Other highlights will include a day chapel, a 6,043-sq-ft social hall, commercial kitchen, nine offices, a workroom and two meeting rooms. The basement level will have youth, music and meeting rooms, as well as storage areas.
