Colorado Appeals Court, Subcontractors Agree on ‘Risk-Shifting’ in Construction Defect Case

On July 9, the Colorado Court of Appeals issued a decision that will help keep construction subcontractors from having to pay claims for design errors caused by others.
In D.R. Horton Inc. versus BD Foundations, et al., the appeals court rejected a design-build contractor’s claim that a contractual indemnity clause allowed it to shift settlement costs for damage caused by its own design errors to subcontractors.
